The Criminal Court yesterday granted temporary release to Pheu Thai MP and red-shirt leader Korkaew Pikulthong on grounds that he had shown remorse for breaking bail conditions earlier.
The court also took into consideration the fact that Korkaew has been detained for 37 days after his bail was revoked on November 30, saying the detention was a severe enough punishment.
The court also accepted Korkaew's explanation that he could not apologise to the Constitutional Court judges because he was defending himself in a lawsuit in which he is accused of intimidating them.
According to the bail conditions, Korkaew was not allowed to participate in any demonstrations and had to refrain from speaking to the press or making comments that could damage other people's or institutions' reputation.
Korkaew is among the people facing terrorism charges in relation to the 2010 red-shirt protests.
His bail was revoked on November 30 after he participated in a red-shirt protest against the Constitutional Court judges. The charter court judges filed a lawsuit against Korkaew, accusing him of intimidating them and thus prompting the Criminal Court to revoke his bail.
Earlier, Korkaew was released from the Bangkok Remand Prison thanks to his immunity as an MP while the Parliament is in session. He then sought temporary release after the Parliament session ended on May 2, but his request was rejected on grounds that he had shown no remorse earlier.
In his latest bail request, Korkaew promised that he would forfeit his right to join rallies and will not make comments that might affect others.
The court decided yesterday that Korkaew had clearly softened his stance and that his promise to not say anything that might be damaging to others showed that he was sorry for breaking his bail conditions.
Korkaew was made to post assets worth Bt600,000 as bail guarantee and was reminded to strictly observe the conditions. The court's decision was met with a smile from Korkaew and cheers from his supporters.
