Q: I will be finishing my job as a teacher in two weeks' time and my work permit will be cancelled.  Can I change it to a retirement visa?


A: Yes, but you have to get the procedure correct.  Obtain a letter from the school indicating your contract is finished and take your passport and work permit to the Labour Department office that issued it.  They will cancel the work permit and issue you with a Tor Tor 10 form as proof. Take this the same day to your local Immigration Office and you can change your non immigrant "B" visa to a one-year retirement visa.  Unless you do this on the same day, you will be charged overstay at 500 baht per day.

Q: I understand how I must cancel my work permit, but I want to stay in the Kingdom another month or so.  Can my non-immigrant "B" visa be extended at the Immigration Bureau?  I have heard the rules recently changed.


A: Once you cancel your work permit the visa is cancelled as well on the same day. Unless you are switching to another one-year visa (see previous answer), the permitted extension is only seven days.  After that, you could  visit the Cambodian border and obtain two weeks on arrival, which can also be extended for a further week.  The total should bring you within striking distance of the one month you need.


Visa refusal reasons


Q: I shall shortly be applying for a tourist visa for my girlfriend to visit the UK.  Before I get involved in all the detail, can you tell me the most common reason for a refusal in circumstances such as this? I have heard it has something to do with her having money in the bank.


A: Of course there are many reasons for refusal of the visa.  But the most common reason is that the entry clearance officer is not satisfied that the applicant will return home and not overstay.  The more incentives to return home the better – a job here and a letter of support from the employer, ownership of property or land, etc.  Just having money in a Thai bank doesn't really prove the applicant will return to Thailand.  He or she could presumably withdraw those funds in advance or at a later date.


Needs retirement visa


Q: I have a Pakistani friend who wants a one-year retirement visa here in Thailand.  He already has 800,000 baht in a Thai bank, but are there any other special factors he needs to bear in mind before leaving Karachi?


A: Don't forget that the 800,000 baht will need to have been in the Thai bank for two months before he applies at Immigration here.  He will need a letter from the bank, not more than a week old, and the bank book as proof.  Additionally, he will need a 60-day tourist visa obtained in Karachi before he leaves.  Pakistani nationals do not qualify for 30 days at the airport on arrival, and he needs to visit the Pakistani embassy in good time before leaving.


Minimum salary for sponsor


Q: I have heard that the sponsor of an applicant for a tourist visa to go to the UK needs to prove he has income of at least 17,500 pounds.  But somebody else told me that this is not true, so who is correct?


A: Currently, the sponsor does need to show clear evidence of income of that level – salary slips, income tax notice, cash in the bank, or whatever, must all be proved.  There is talk of revising this rule as it has caused a lot of controversy, but we do not know of any changes at the time of writing.  Watch this space!


Three-year visa


Q: I have heard that some Thai embassies abroad are now giving three-year visas and I am wondering if you know the details.  I was under the impression that one year was as long as you can obtain from embassies abroad.


A: There is a three-year, non-immigrant, and multiple-entry visa (3 months at a time) but it is only for regular business people.  It is obtainable at Thai embassies in most European countries and America. However, you will need clear documentation that you will be doing business in Thailand.  The most likely source would be the Board of Investment which can issue you with the supporting certificates provided you can prove your intention, or that of your company, to invest or do long-term business in the country.
