The Court of Appeals Wednesday dropped theft charge against two red-shirt people who were arrested in the heart of Bangkok during May 2010 political violence.
The Appeals Court found that public prosecutors did not have strong evidence to back up the theft charge against Prasong Manee-in and Kowit Yaemprasert.
Prasong and Kowit were arrested by troops at a security checkpoint on May 17 2010 while driving a pick-up truck.
The Criminal Court sentenced the two to eight months in jail for violating the state of emergency, six years in jail for having bombs in possession.
But Appeals Court ruled that although the two had stolen goods from a 7-Eleven shop in possession, there were no evidences that they broke into the shop.
As a result, the Appeals Court altered the theft conviction to be conviction in having stolen items in possession and sentenced them to three years in jail for this conviction.
